Privacy notice

ClearCDM is a trading style of Robbie Thompson Design Ltd (Co. No. 10355527) and James Nicholson Design Ltd (Co. No. 13960890). The two companies are joint controllers of the personal information handled through this site and the service; the contact for anything in this notice is [email protected].

What we collect. When you enquire: your name, contact details and what you tell us about your project. When we are appointed and you or your project team complete our online forms: names, companies, roles and contact details; project and site information; design risk information; files you attach, such as drawings, surveys and reports; and, on the client form, the typed and drawn signature that records acceptance of the appointment.

Why, and on what basis. To provide the principal designer service under our appointment (performance of a contract); to answer enquiries and prepare quotations (legitimate interests); and to keep the records the service properly generates, including the pre-construction information pack, the information register and the health and safety file (legitimate interests and legal obligation, since CDM 2015 requires this information to be prepared and passed on).

Who sees it. Project information is shared with the people who need it for the project: the client, the designers, the contractor and anyone properly quoting for or planning the works, through the core CDM outputs. We do not sell personal information and we do not use it for marketing.

Who processes it for us. Form submissions are delivered through Google (a form backend running on Google infrastructure) and stored in Dropbox; email runs on Google Workspace; the site is served by Cloudflare. Each acts as a processor under its own terms.

How long we keep it. Project records are kept for [retention period, Robbie to confirm, typically the period required by our insurers] after the project ends. Enquiry correspondence that does not become a project is kept for [period, Robbie to confirm].

Your rights. You can ask for a copy of your personal information, ask for corrections, ask for deletion where the law allows, and object to processing based on legitimate interests. Write to [email protected]. If you are unhappy with our answer you can complain to the Information Commissioner's Office at ico.org.uk.
